1. Acceptance of Terms

By accessing and using this LMS, you agree to be bound by these Terms of Service. If you are accessing the platform via a corporate, SETA-sponsored, or academic program, these terms apply to you as an individual learner.

2. Learner Responsibilities & Account Security

  • Access Credentials: Your account and login details (usernames and passwords) are strictly for your personal use. You should not share your account or allow third parties to complete tasks on your behalf.
  • Accuracy: You must ensure that all profile details—such as your full name, and contact information – are accurate and up to date. These details are often used for accredited certification and reporting.

3. Intellectual Property & Course Content

  • Usage Rights: All content provided on this LMS, including videos, PDFs, quizzes, and assessments, remains the intellectual property of the content provider or institution.
  • No Distribution: You are strictly prohibited from downloading, copying, distributing, or sharing course materials with others or uploading them to external peer-to-peer file-sharing sites.

4. Code of Conduct & Academic Integrity

  • Professional Engagement: All interactions, such as forum discussions, chat rooms, and messages, must remain professional, respectful, and free of discriminatory or offensive language.
  • Plagiarism and Cheating: Any form of academic dishonesty—including unauthorized collaboration, submitting someone else’s work as your own, or using AI tools to cheat on assessments – will result in immediate suspension or expulsion from the course.

5. Privacy and Data Protection (POPIA)

  • POPIA Compliance: Your personal information (e.g., contact details, progress tracking, and assessment results) is processed in accordance with the Protection of Personal Information Act (POPIA).
  • Data Usage: By using the LMS, you consent to the collection and processing of your data. This is typically used for tracking learning progress, reporting to Sector Education and Training Authorities (SETAs), or verifying your qualifications.

6. E-Assessments & Moderation

  • Portfolio of Evidence (PoE): Your electronic assessments and portfolios are stored as official evidence. You must ensure all uploaded assessments are your own work.
  • Audit Rights: Your account records, grades, and uploaded documents may be viewed by registered moderators, assessors, or SETA verifiers to ensure the credibility of your e-learning qualifications.

7. Limitation of Liability & Governing Law

  • Platform Availability: While we strive to ensure 24/7 access to the platform, we cannot guarantee uninterrupted service. We are not liable for disruptions caused by internet service providers, load-shedding, or technical failures outside our control.
  • Governing Law: These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes arising from the use of this LMS shall be subject to the jurisdiction of South African courts.

8. Amendments and Termination

  • Changes to Terms: The platform administrators reserve the right to amend these terms at any time. Continued use of the LMS after changes constitutes your acceptance of the new terms.
  • Termination: The institution reserves the right to terminate your access to the platform without notice if you violate any of the terms outlined in this agreement.
